The Meadows Covenants, Conditions & Restrictions (CC&Rs) & Bylaws
The Meadows CC&Rs is recorded with the Madison County Clerk's Office and is the official document for governance of The Meadows Homeowners Association. Also contained in the same recorded document are the bylaws of the Association. Among other things, the CC&Rs explain how the HOA board functions, the rights and obligations of owners and board members, and the rules for the Common Areas.
Currently, not all Association Rules and Regulations are written into the document. This is because Article II, Section 3 of the Bylaws (Duties and Powers of the Association) grants the Board the right to "adopt, amend, repeal and enforce reasonable Rules and Regulations [that] benefit the Development as a whole." The board gives owners prior notice of any such rules and regulations. Being recorded as part of the original 8-building development in 2004, the CC&Rs are significantly out-of-date, and they do not incorporate many important additions to the Rules and Regulations. IMPORTANT NOTE: The PDF provided on this page contains three (3) instruments. Even though much of the content is duplicated across these three instruments, all three are provided to ensure clarity as explained below.
The first instrument (#313227) was recorded on 9 July 2004, as the "Declaration of Covenants, Conditions and Restrictions of The Meadows" but did not include Bylaws. The Bylaws were first recorded on 2 September 2004 (Instrument #314446), wherein the original CC&Rs were re-recorded as the "Declaration of Covenants, Conditions and Restrictions of The Meadows Homeowners Association," as opposed to merely "The Meadows."
This second instrument in the series, however, left out page 5 of the CC&Rs portion; therefore, it was re-recorded on the same day as Instrument #314447, only the name changed from "Declaration...of The Meadows Homeowners Association" to "The Meadows Condominium Association." The reason for this name change is uncertain; however, it is assumed that at some point, the original developer had multiple files (perhaps even a template) for creating CC&Rs and simply used the wrong version when recording the last instrument. This is one of the reasons all three instruments are included in the PDF, because The Meadows is in fact a townhouse community, not a condominium association.
The succession of instruments shows this progression and that the term "condominium" was never intended to describe The Meadows. This is important, because townhouse ownership includes the ground on which the unit stands, whereas condominium ownership only includes the inside of the unit.
